1. Personal Data Protection Notice
1.1  This Personal Data Notice (“Notice”) describes how Evyap Sabun Malaysia Sdn. Bhd. (“ESM”) (a private limited company incorporated under the laws of Malaysia with its place of business at Plo 70, Jalan Nibong 4, Tanjung Langsat Industrial Complex, 81700, Pasir Gudang, Johor, Malaysia) collects, processes, discloses and stores your Personal Data.
1.2 By engaging ESM in any commercial transactions, or by disclosing your personal data to ESM, or by using the ESM website  www.evyapoleo.com (“Website”), you consent to the processing of your Personal Data (or sensitive personal data, if relevant) by ESM.
1.3 In the event of any conflict between the English and other language versions, the English version shall prevail. ESM shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the Website. By continuing to communicate with ESM or by continuing to conduct commercial transactions with ESM following the modifications, updates or amendments to this Notice, this shall signify your acceptance of such modifications, updates or amendments.

2. Collection of Personal Data
2.1 “Personal Data” means information about you which you have provided to ESM, such as your name, address, telephone number, passport number or national identity card registration number, email address, particulars of your spouse or family members and bank account information and any information which may identify you, your spouse or family members that has been or may be collected, stored, used and processed by ESM from time to time.
2.2 In addition to the Personal Data you provide to ESM directly (i.e. during your communications with ESM, in any documents submitted to ESM, in any commercial transactions with ESM, and/or when you apply for any position or internship with ESM), ESM may also collect your Personal Data from a variety of sources, including without limitation at any events organised by ESM.
2.3 The provision of your Personal Data is voluntary. However, if you do not provide your Personal Data, ESM may not be able to (i) communicate with you; (ii) enter into commercial transactions with you; or (iii) assess your suitability for employment/internship with ESM.
2.4 Where applicable and relevant, you also give explicit consent to ESM to process any sensitive personal data such as religion, criminal background, medical history for employment purposes and engagement as agent, contractor, distributor and others.

3. Purposes of Processing
3.1 ESM may use and process your Personal Data for the purposes relating to the services you have requested and for the business activities of ESM which shall include, without limitation:-

4. Transfer of Personal Data
4.1 As ESM’s information technology storage facilities and servers may be located in other jurisdictions, your Personal Data may be transferred to, stored, used and processed in a jurisdiction other than Malaysia. You understand and consent to the transfer and usage of your Personal Data out of Malaysia as described herein.

5. Disclosure to Third Parties
5.1 ESM will not sell, disclose or lease your Personal Data to third parties unless we have your permission or are required by law.
5.2 Where necessary in performing the Purposes of Processing, ESM may engage other companies, service providers or individuals to perform functions on ESM’s behalf, and consequently may provide access or disclose your Personal Data to the third parties such as those listed below (not exhaustive):

6.1 Any Personal Data that ESM collect will be retained by ESM and/or any of the parties to whom any Personal Data has been disclosed to, for as long as necessary to fulfil the many different purposes outlined in this Notice in line with our internal retention policies or as required to satisfy legal, regulatory, taxation and/or accounting requirements or to protect ESM’s interests.

7.1 ESM is committed to ensuring that your Personal Data is secure. We will protect your Personal Data in accordance with laws in Malaysia by implementing physical, electronic, technical and administrative procedures to safeguard and secure your Personal Data.

8. Accuracy and Updating of Personal Data
8.1 When you provide your Personal Data to ESM, you undertake that all such information provided is accurate, complete and up-to-date. If there are changes to your Personal Data or if you believe that the Personal Data we have about you in inaccurate, incomplete, misleading or not up-to-date, please contact us, the details as stated below, so that we may take steps to update your Personal Data.
8.2 ESM may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access to correct the Personal Data is not otherwise required by local law.
